Podcast: Restructuring across borders toolkit – Netherlands
Following on from the relaunch of A&O Shearman’s Restructuring Across Borders Toolkit, colleagues from across our European network sat down with Christopher Poel for a new podcast series. In it, they discuss what pre-insolvency rescue and compromise proceedings are available to debtors in various jurisdictions, and whether there have been any novel, exciting uses and deployments of those processes.
The second podcast in the series takes a look at the restructuring space in the Netherlands with Geza Orban and Gijs Kerstjens from our Amsterdam restructuring team. We consider the WHOA, the Dutch debtor-in-possession court-confirmed procedure that offers a lifeline to struggling businesses by enabling them to restructure their debts outside of formal insolvency proceedings, as well as recent developments and some of the key areas of focus and challenge which have arisen recently.
