News update: ESMA publishes second package of final draft technical standards under MiCAR

On 4 July 2024, the European Securities and Markets Authority (ESMA) published its second package of final draft technical standards under the Markets in Cryptoassets Regulation (MiCAR), including six draft regulatory technical standards (RTS) and two draft implementing technical standards (ITS).

The technical standards relate to the following:

  1. sustainability indicators in relation to adverse impacts on the climate and other environment-related adverse impacts – RTS;
  2. business continuity measures for cryptoasset service providers (CASPs) – RTS
  3. trade transparency for CASPs operating a trading platform for cryptoassets – RTS;
  4. record-keeping requirements for CASPs – two RTS;
  5. cryptoasset white paper formats and the data necessary for the classification of cryptoasset white papers and the practical arrangements to ensure that such data is machine-readable – ITS and RTS; and
  6. public disclosure of inside information – ITS.

The technical standards will be submitted to the European Commission, which will have three months to decide whether to adopt them.
