The latest episode in our insurance series looks at the benefits of directors’ and officers’ liability (D&O) insurance and the key considerations when purchasing this protection.

D&O insurance exists to indemnify directors and officers against allegations arising from decisions and actions taken in their corporate roles. It covers defence costs and compensation payments due to claims.

The conversation is led by insurance litigation and cyber partner Charlie Weston-Simons, with insights from insurance litigation partner Russell Butland and head of management liability at Marsh UK, Helen Haggie.

In this podcast, we discuss three broad risk areas for boards:

  • Event-driven litigation and enforcement: How are ESG, particularly environmental, and cyber risks driving litigation and enforcement action? (From 4.32).
  • The UK regulatory environment: Regulatory change is giving rise to new exposures. (From 21.51).
  • The economic environment: Insolvency risk has potentially significant implications for directors and officers in their personal capacity. (From 28.04).

We also focus on some key takeaways related to the importance of working with your broker to evaluate management liability risk and obtain an appropriate D&O insurance policy.
