A&O Shearman represents Department of Energy in loan to Eos Energy Enterprises, Inc. to advance next generation battery energy storage systems

A&O Shearman represented the U.S. Department of Energy in closing a USD303.5 million loan to Eos Energy Enterprises Inc. to finance the construction of two state-of-the-art production lines that will be able to produce enough stationary batteries per year to service the annual electricity needs of approximately 130,000 homes.

These facilities will produce “Eos Z3™,” a next-generation utility- and industrial-scale zinc-bromine battery energy storage systems (BESS) in Turtle Creek, Pennsylvania. Pending additional LPO approvals and completion of an Environmental Assessment pursuant to NEPA, two additional lines in Duquesne, Pennsylvania, may also be included as part of the loan guarantee.

The loan guarantee was arranged through the LPO’s Title 17 Clean Energy Financing Program, which includes financing opportunities for innovative energy and supply chain projects that reinvest in existing energy infrastructure. The award was announced on December 3, 2024, in a press release.

The A&O Shearman team was led by energy, natural resources and infrastructure (ENRI) partner Jillian Ashley, and included ENRI counsel Rebecca Stubbs, ENRI associates Niso Matari, Aswini Endlur, Zeina Traboulsi and Simran Kaur, ENRI law clerk Juan Santiago, ENRI paralegal Christian Cho, restructuring partner Mark Shapiro, restructuring associate Joe Badtke-Berkow, IP partner Keren Livneh, IP associate Will Jackson, environmental & sanctions counsel Maria Christopher Bell, environmental & sanctions associate Jake Ely and real estate partner Adam Sofen.
