Monika mainly focuses on contentious work for financial institutions and advises leading banks on complex financial disputes, as well as on consumer litigation related to financial products. 
She also has vast experience in advising financial creditors on the recovery of claims, including foreign banks participating in insolvency proceedings involving Polish companies.

Experience

Representative matters

  • Polish banks in several lender liability disputes, eg a landmark case in which a borrower sought to challenge the takeover of shares of a listed company under a registered pledge agreement.
  • A major Polish bank in several export credit insurance related disputes regarding different projects in South-East Asia, Russia and Central Europe with the amounts at stake exceeding EUR75m.
  • A leasing company in a multi-layered commercial litigation covering brokerage commission issues, the ex-director’s liability and the termination of crucial cooperation contracts.
  • A state-owned investor in high-profile construction litigations and providing on-going claim management advice regarding potentially contentious warranty claims and payment retention.
  • An insurance company in class action proceedings where 150+ consumers argued that their unit-linked life insurance agreements were invalid.
